PUMP STATION AGREEMENT TIMELINE

October 2024 - an agreement is reached for use and eventual ownership between the sponsor and BME HOA.  Both the sponsor and the HOA have signed the agreement; however, in September, 2024, the board became aware that a third party's signature was needed to finalize the agreement.  Up to that point, we were told by the sponsor that no other parties would be involved in this negotiation.  We are currently awaiting the third party's signature so that the agreement can be executed.

August 2024 - the sponsor agrees to a preliminary engineer's inspection of the pump station to satisfy the HOA board's initial requirment of ensuring that the pump station is in good working order with no major issues or concerns.

February-May 2024 - a draft agreement is drawn up by attorneys for both parties.  The draft is reviewed and edited several times.

January-April 2024 - the Board engages in extensive research with various entities (Town of Islip, Suffolk County Sewer Authority, Mid Island Environmental, Commander Power Generator, etc.) to learn as much as possible about owning and operating a pump station.

December 2023 - the board has a zoom meeting with the sponsor to review aspects of the pump station agreement that have been negotiated between the HOA board and the sponsor.  Both parties agree that we are ready to move forward with a formal, legally binding agreement.  The sponsor claims this should all be "wrapped up by the end of January" (2024).

July 2023 - following verbal negotiations between the sponsor and designated HOA board members, board members develop a blueprint outlining the specifics of the community's needs regarding usage and potential ownership of the pump station.

June 2023 - HOA board members meet with a representative from Mid Island Environmental, who provides monthly maintenance of the pump station.  The board tours the pump station to learn about the operations.

May 2023 - the sponsor again meets with designated board members to review the status of his completion of Bayport Gardens and the need to resolve the pump station usage and ownership issue.  

August 2022-April 2023 - several months pass with no further discussion or action from the sponsor to proceed with regard to resolving this matter.

July 2022 - the sponsor contacts the HOA Board to discuss the future of the pump station.  Designated members of the board meet with the sponsor.  The sponsor wishes to complete his Offering Plan for Bayport Gardens and needs to resolve the BME Offering Plan discrepancy of ownership of the pump station, since Bayport Gardens will be a user of the pump station.
